When making a purchase via our on-line shop, you accept that the purchase is subject to the terms and conditions described below.

1. ORDERING AND PAYING

You can buy our products in our on-line shop. If you have any questions about products not displayed on the website or if you wish to place an order by telephone, please feel free to contact us on 03 9425 9253 or at info@cane-line.com.au.

To make a purchase, please complete the following steps:

  1. Find the product you want to buy and put it in the basket
  2. You may then return and continue shopping
  3. Check the items in your basket
  4. Accept the terms of sale and delivery
  5. Enter your contact details and delivery address
  6. Go to order
  7. Check that all information is correct, including delivery method, accept and proceed to payment
  8. Enter your card details and execute the payment

When the purchase has been completed, you will receive an order confirmation.

When you make a purchase in the shop, a purchase agreement is entered under Australian law.

Freight costs will be calculated just before you approve the payment. If the shipping fee is not calculated in the check out, you will be contacted by us regarding a shipping quote for your delivery, after the placement of your order.

2. WARRANTIES (YOUR RIGHT TO LODGE A COMPLAINT)

When you shop on-line with Cane-line, you have a general 24-month warranty.
Cane-line reserves the right to reject a complaint if there has been improper use of the product or if the product has been manipulated/modified by a third party, including attempted repairs. Cane-line alone decides the above.

3. PAYMENT

We accept the following payment methods:

No fees are charged for payment on the website.

All prices are including GST and other duties. The prices are directional. Shipping costs are not included.

Payment is charged when the order is placed.

All our orders are checked for possible fraud. This involves checking information entered during the ordering process, including address information. This may involve that your data are disclosed to a third party for fraud control purposes. We may occasionally request you to provide additional information to process your order. We will complete this process as quickly as possible, but it may cause a delay in the dispatch of items.

The price you pay is the price displayed on this website at the time at which we receive your order. We always try to ensure that all prices displayed on our website are correct, but errors may occur. If we discover an error in the price of items you have ordered, we will inform you as soon as possible and allow you to confirm your order at the correct price or cancel it. If we are unable to contact you, we will treat the order as cancelled. If you cancel the order and you have already paid for the item, you will receive a full refund of the amount.

The title to all products you order on this website will pass to you on delivery of the products, provided that we have processed and received full payment for the products.

Credit card transactions are executed in accordance with the table below.

4. AVAILABILITY

Items and their delivery time are subject to availability. If we are unable to deliver an item, we will inform you thereof as quickly as possible. You will receive a full refund if you have already paid for the item(s).

5. CHANGING AN ORDER

You can change the contents of your basket right up until you confirm your purchase by pressing the ‘Go to secure payment’ button. Your order will subsequently be processed by Cane-line and can no longer be changed.

6. DELIVERY AND DELIVERY TIMES

For purchases over 750 AUD = delivered carriage paid to Melbourne / Sydney / Brisbane metro areas.

For purchases under 750 AUD = the freight rate is 50 AUD to Melbourne / Sydney / Brisbane metro areas.

Delivery to the other capital cities or regional areas will be quoted.

Shipping costs may vary depending on the products you choose and the address to which you want the products to be delivered, and they are non-refundable. We make every effort to deliver the ordered items within the specified delivery times.  Cane-line cannot be held liable for any delays or non-delivery of products within the estimated time frames.

Cane-line aims to deliver ordered items within 5-14 working days.

For products that are not in stock when the order is placed, you will be informed about the expected delivery time. Cane-line handles delivery through external freight forwarders.

If, in connection with the purchase, you want an order to be delivered to a neighbour, at the address or elsewhere without a receipt for delivery, please contact Cane-line at info@cane-line.com.au. Please note that, in such case, the items will be left for your own account and risk. Cane-line cannot subsequently be held liable for faults or defects.

7. PACKAGING AND SHIPPING

All products are shipped in our standard packaging to ensure the best and safest delivery.

8. CHANGE OR CANCELLATION OF ORDER

If you want to change or cancel an order, please contact us by telephone on 03 9425 9253. This is the only way we can guarantee that an order will be cancelled before the item is shipped. If your order has not yet been shipped, it may be cancelled free of charge. If your order has been shipped, you are obliged to pay the shipping costs. We request that items be returned in their original packaging, alternatively in corresponding secure packaging. The customer is responsible for disposal of packaging and pallets after receipt of furniture.

Cane-line may cancel an order if it is not possible to deliver the ordered item(s). You will be notified if such a situation should arise, and any payment or reservation of an amount charged to a means of payment will be cancelled and refunded. Cane-line may cancel your order due to typographic errors, technical problems, delivery failure or similar situations.

9. ORDER CONFIRMATION

Once you have placed your order, you will receive an order confirmation, which is a binding legal purchase agreement.

10. Change of mind policy

You have 7 days’ right of withdrawal when shopping with us.

The change of mind period expires 7 days after the day on which you:

  • have received your item(s)
  • have taken physical possession of the last item when this concerns an agreement for multiple items, ordered as one single order, and delivered individually
  • have taken physical possession of the last lot, or the last part of the consignment, if this concerns an agreement on delivery of an item consisting of several lots or parts.

You must notify us within 7 days of receipt that you wish to withdraw from your purchase. The notification must be given using our electronic standard form

You cannot exercise a right of withdrawal by refusing to take delivery of the item without having given us clear notification thereof.

11. RETURN OF ITEM(S) WHEN EXERCISING THE 7 DAYS’ RIGHT OF WITHDRAWAL

You must return your ordered item(s) to us without undue delay and no later than 7 days after you have informed us that you wish to withdraw from your purchase. You must pay the direct costs connected with returning the item(s).

When returning ordered items, you are responsible for ensuring that they are packed securely in their original packaging.

You bear the risk of the item(s) from the time of delivery thereof.

Covers, rugs and pillows can be returned by normal post. All other items must be returned by courier or regular carrier.

Cane-line is happy to help you with the booking and collection of returns.

12. REFUND OF PURCHASE AMOUNT

If you exercise your right of withdrawal, we will refund all payments received from you, including delivery costs (except for any additional costs resulting from your own choice of another delivery type than the cheapest form of standard delivery which we offer), without undue delay and in any circumstance no later than 14 days from the date on which we have been notified of your decision to withdraw from this agreement. We will make a refund using the same means of payment that you used for the original transaction.

The paid amount will be credited to your account on receipt, approval, and acceptance of items at our showroom in Richmond, Victoria. If Cane-line books and handles the collection of items, the amount will be deducted from the refund for returns.

Any deterioration in value for which you are liable will be deducted from the purchase amount.

We will check the item(s) upon reception, and you will receive a refund of the purchase amount within 14 days.

 

NOTE:
You may lose your purchase amount, in full or in part. This happens if the value of the item has deteriorated because:

  • you have taken the item into use,
  • it has been damaged while you were responsible for it,
  • you have handled the item in another manner than necessary for you to be able to ascertain the nature and properties of the product and its mode of functioning.

13. COMPLAINT – IF THERE IS SOMETHING WRONG WITH THE ITEM

Your purchase is covered by the Australian Consumer Law including the rules of defects. This means that you can have a defective item repaired or replaced, receive a refund or a price reduction, depending on the situation in question. Your statutory right to complain is valid for 24 months.

It is, of course, a requirement that the complaint is justified and that the defect has not occurred because of improper use of the product or other behaviour that has damaged the product.

14. YOU MUST CONTACT US WITHIN A ‘REASONABLE TIME’

You must complain within a ‘reasonable time’ after you have discovered the defect in the item. We recommend that you complain as quickly as possible and within two months from when the defect was ascertained.

15. IN CASE OF A LEGITIMATE COMPLAINT, WE WILL REFUND REASONABLE FREIGHT COSTS

If your complaint is legitimate, we will of course refund your reasonable freight costs for returning the item to us. Otherwise, you must yourself bear all transport costs, including our freight costs, for return of the item after we have examined it.

Remember that the item must always be sent in proper packaging and remember to get a dispatch receipt. You are responsible for the package/items until our receipt thereof. You should therefore save the receipt, including information about freight costs and any tracking number.

When you return the item, please specify the problem in as much detail as possible.

 16. DAMAGED ITEMS ON RECEIPT

You must inspect your products when you take delivery, and you will be required to note any damage on the delivery documentation which is presented to you for signing upon delivery.

Please contact us within 48 hours of delivery by submitting an electronic return and complaint form https://cane-line.com.au/pages/service (indsæt link)and we will then arrange for collection and replacement.

Upon our receipt of the product, you will receive an email confirming that we have received the returned item and what the further complaint process will be.

If Cane-line cannot find any defects in the returned products, these will be returned to you again for your account.


It is, of course, a requirement that the complaint is justified and that the defect has not occurred because of improper use of the product or other behaviour that has damaged the product.


17. MISSING ITEMS

On delivery: If an item is missing in your delivered consignment, please let us know within two working days from receipt of the delivery. Cane-line cannot be held liable for missing items if you have requested delivery without a receipt being required. If items are missing, this must be entered on the consignment note. Subsequent delivery of missing items will be made as soon as possible.

18. EXCLUSION OF LIABILITY

Unless otherwise expressly stated in these terms, our liability for damages for any product purchased on our website will be strictly limited to the purchase price of the product in question.

Regardless of the above, our liability for damages cannot be derogated from in the event of:

  • death or personal injury caused by our negligence
  • fraud or fraudulent deception
  • unlawful exclusion or limitation of our liability for damages or attempts at such exclusion or limitation.

Exclusions of liability are governed by and interpreted in accordance with Australian law.

19. GOVERNING LAW, COMPETENCE AND LANGUAGE

This website and any agreement entered because of the use of this website are governed by and must be interpreted in accordance with Australian law. Any disputes will be settled by a Australian court. All agreements are entered into in English.

20. VOUCHERS

We regularly offer vouchers as part of our marketing. The codes for these vouchers are only valid for limited periods and may be subject to special conditions. The codes may be limited to being usable only in connection with special products, categories, or brands.

When you use a voucher, you must purchase the specified minimum amount. If you purchase for less than the specified minimum amount, the difference will not be refunded. Any voucher you wish to use must be entered in the purchase process before you pay for the order. You cannot be credited a forgotten voucher after the order has been placed. Only one voucher can be used per order.

The vouchers are not personal and can be used by the holder. The vouchers have no cash value and cannot be redeemed for cash, credit vouchers or the like.

In the event of fraud, attempted fraud, or suspicion of other illegal activities in connection with the redemption of vouchers, we are entitled to cancel the voucher, to cancel the order on which the voucher has been used and to block your access to shop on-line at Cane-line permanently.
